What is a Healthcare Provider Claim?

A Healthcare Provider Claim as defined in the Plan includes, without limitation, (i) the Claims set forth in the approximately 1,030 Proofs of Claim filed by hospitals and the approximately 445 Proofs of Claim filed by other treatment providers (listed in Exhibit “C” of the Plan) and (ii) Claims against the Debtors held by Non-Federal Acute Care Hospitals.

Who is a Claimant?

A Claimant is the Holder of a Healthcare Provider Channeled Claim and is either (i) the operating entity that owns one or more Hospitals, or (ii) an individual that is another treatment provider, in each case having timely filed a Proof of Claim.

How do I know if I qualify as a Healthcare Provider Authorized Recipient?

To qualify as a Healthcare Provider Authorized Recipient, a Holder of a Healthcare Provider Channeled Claim must certify in its Claim Form that:

(a) It adheres to the standard of care for the emergency department, hospital wards and outpatient clinics at the time of any prospective evaluation, diagnosis, and treatment of OUD, including with respect to the applicable standard of care for the treatment of addiction, acute withdrawal and treatment for Opioid Use Disorder (“OUD”) with medication assisted treatment; and,

(b) It provides discharge planning and post-discharge care coordination for patients with OUD, including information for appropriate OUD treatment services; and,

(c) A Holder of a Healthcare Provider Channeled Claim must demonstrate through the Requisite Claims Data that it has been damaged in the past and reasonably anticipates incurring additional abatement expenses in the future arising from patients suffering from OUD; if it does not do so, then it will not receive any Distribution.

What do I need to do to qualify for a Distribution?

In order to qualify as a Healthcare Provider Authorized Recipient and be eligible to receive a Distribution, Holders of Healthcare Provider Channeled Claims (a “Claimant”) must comply with the terms, provisions and procedures set forth in the Healthcare Provider TDP), including the Claim Deadline and the timely submission of all forms and data required pursuant hereto.

How do I know if I am eligible to receive a Distribution?

To qualify to receive Distributions from the Healthcare Provider Trust, each applicable Holder of a Healthcare Provider Channeled Claim must:

(a) Have timely filed a Proof of Claim in the Debtors’ Chapter 11 Cases (that is, on or before July 30, 2020);

(b) Timely submit the Claim Form; and

(c) Provide all of the Requisite Claims Data in connection with submitting a Claim Form.

Where do I submit questions related to the Claim Form?

Questions relating to the Claim Form should be submitted to: info@purduehospitalsettlement.com.

How do I submit the Claim Form, Requisite Claims Data and other required documents and information?

The Trustee (or its agents or representatives) will contact the person listed as the contact on the Registration Form and provide the SFTP instructions within five business days of receipt of sufficient registration information.

Where do I obtain and complete my Registration Form?

A Registration Form can be obtained online by clicking here and submitting it to: info@purduehospitalsettlement.com.

How do I communicate with the claims administrator?

All communications with the claims administrator should be directed to info@purduehospitalsettlement.com. When corresponding, please identify the applicable Claimant by name. After a Claimant number has been assigned, please include the Claimant number, as well, in all subsequent communications.

What is the total amount of money available in the Healthcare Provider Trust?

The net distributions from the Purdue Pharma bankruptcy estate to the Healthcare Provider Trust currently total approximately $71.5 million, however, that sum will be reduced by certain additional court-approved legal fees allocated for the Ad Hoc Group of Hospitals that negotiated this settlement and its inclusion in the confirmed Plan, a common benefit assessment, as well as certain other associated Healthcare Provider Trust expenses. The Distributions from the Healthcare Provider Trust are also dependent on the number of eligible Claims ultimately approved to receive a Distribution.

What damages do I need to demonstrate to receive a Distribution?

A Holder of a Healthcare Provider Channeled Claim must demonstrate through the Requisite Claims Data that it has been damaged in the past and reasonably anticipates incurring additional abatement expenses in the future arising from patients suffering from OUD; if it does not do so, then it will not receive any Distribution.

How do I submit a Claim?

If you receive the Notice and wish to submit a Claim, you must download, complete, and submit a Registration Form to info@purduehospitalsettlement.com. Upon receipt of your Registration Form, you will be provided with instructions for accessing a secure file transfer protocol (SFTP) site, through which you must submit the required Business Associate Agreement (BAA), Claim Form, and Requisite Claims Data.

What Requisite Claims Data must be submitted to qualify for a Distribution?

 The Requisite Claims Data requirements are set forth in Section D.7. of the Claim Form.
